SYNOPSIS
The Registration of Engineers Act 1967 and the Registration of Engineers Regulations 1990 have been amended in 2015 with date of operation on 31st July 2015. These latest amendments are a direct result of Government policies on trade for services. As Malaysia developed towards a service industry, the issue of “liberalisation” of the services came to the forefront in the Free Trade Agreements (FTA) which the country signed. The amendments in 2015 directly address liberalisation issues in order for the country to meet its international obligations.
Regulation 34A (1) of the Registration of Engineers Regulations 1990 (Amended 2015) allows a body corporate registered as an Engineering Consultancy Practice (ECP) to open up to 30 % of its shareholdings to non-PEPC (Professional Engineer With Practising Certificates or investors to become shareholders in the ECP.
Regulation 34B (1) of the Registration of Engineers Regulations 1990 (Amended 2015) states that least two thirds of the Board of Directors of the body corporate registered ECP shall be PEPC and under the Registration of Engineers Act 1967, Section 7A(3) (iv) it is mentioned that the day-to-day affairs of the body corporate shall be under the control and management of a person whom is a PEPC.
In the recent development, the Board of Engineers, Malaysia (BEM) has the intention to further allow body corporate ECPs the flexibility and option to open up to their entire shareholdings to non-PEPCs, whilst retaining the provision of the Regulation 34B (1) and the provision under the Registration of Engineers Act 1967, Section 7A (3) (iv).
Hence IEM via the Consulting Engineers Special Interest group CESIG is inviting the regulatory and Industry stakeholders to explain the rationale of the amendment to all body corporate ECPs and at the same time obtain feedback from the IEM members on these amendments. A survey would also be conducted by IEM to our IEM Members as well after this talk.
