SYNOPSIS

For the past 20 years there has been a remarkable surge in the implementation of engineering and building contracts on design and build method of procurement. Among the contributory factors are the obvious advantages of single-point responsibility, likely guaranteed cost of construction, more certain completion time and reduced opportunities for claims by the contractors. Of course the above advantages can only be achieved if important and key principles are observed by the parties involved ie the Employer, the Contractor, the Professionals (Architects, Engineers, QS etc) and the Project Managers.

This short courses designed to achieve 2 objectives. Firstly to provide a practical guide to assist the parties in knowing what to do when performing a Turnkey/Design and Build Contract; secondly, to assist parties in knowing some potential problems and pitfalls of Turnkey/Design and Build Contract and the possible ways to minimize them in the course of the work.

BIODATA OF SPEAKER

Ir. Lai Sze Ching graduated as a Mechanical Engineer from University of Malaya. He also holds LL.B degree from University of London and LL.M from University of Malaya, majoring in Construction Law, Alternative Dispute Resolution, Arbitration Law, Remedy and Civil Procedure. In addition, he also holds a Certificate of Legal Practice from Qualifying Board of Malaysia and Diploma in International Commercial Arbitration (CIARB UK). Ir Lai is a Fellow Member of Chartered Institute of Arbitrators (UK), Malaysian Society of Adjudicators, Malaysia Institute of Arbitrators and Asian Institute of Alternative Dispute Resolution. He is also a Fellow Member of the Institution of Engineers, Malaysia (IEM) and Honourable Fellow Member of Asean Federation of Engineering Organisation.

Ir. Lai has more than 30 years working experience in the field of construction, property development and contractual claims. He is currently the Managing partner of Lai & Teh Adjudication & Arbitration Chamber Plt and the Managing Director of GnP Project Management Sdn Bhd specialised in project and contract management for engineering construction. He has authored many articles on ADR, Arbitration and Construction Law and a contributing author for the CIDB Law Reports. Over the years, he has conducted talks on ADR, Law for Engineers and on Construction Law to members of IEM, local companies and Universities.

Being an accreditator of Engineering Accreditation Council Malaysia, he is also actively involved in the accreditation of local engineering programme. Ir. Lai is also appointed as the Student Ambassador for the External Law Programme of University of London since 2006. He is empanelled as Arbitrator, Mediator and Adjudicator in the panel of Asian International Arbitration Centre, Malaysia (AIAC). He is also empanelled as Arbitrator in the panel of Institution of Engineers Malaysia.
