Synopsis

This is a 1-Day course, which will outline all that Project Managers and Engineers need to know about Adjudication and Mediation in Malaysia. Participants will obtain an understanding of the advantages and disadvantages of each approach, which kind of dispute is suitable for each method, and how they relate to other forms of dispute resolution, such as arbitration. Participants will be equipped with all of the information that they need in order to assist their employers to initiate proceedings, or respond to proceedings in relation to both Adjudication and Mediation. The course will outline the requirements imposed by the Mediation Act 2012, and the Construction Industry Payment and Adjudication Act 2012, and the practical implications of these statutes. The course will also ensure that participants are informed of current changes in the law in a succinct and practical way.

About The Course Leaders

1) Ms. Samrith Kaur
    - LL.B. (Hons) Coventry in year 1992, UK; C.L.P., LL.M.; FCI Arb; FM1Arb;
      Advocate & Solicitor of the High Court of Malaya Adjudicator, Arbitrator & Mediator
  
Ms. Samrith Kaur, an advocate and solicitor also holds a Master degree in Law from University of Malaya where her area of interest is in Alternative Dispute Resolution, Arbitration, Construction, Employment, Sports and Information, Communication and Technology Law.  She is a Fellow of the Chartered Institute of Arbitrators, United Kingdom and with the Malaysian Institute of Arbitrators. She was past Vice Chairman of the Chartered Institute of Arbitrators, Kuala Lumpur Branch (2012-2014). Ms. Samrith is a Certified Mediator and is on the panel of Bar Council Malaysian Mediation Centre (MMC) and as Arbitrator, Mediator, Adjudicator and Domain Name Dispute Resolution Panelist with the Asian International Arbitration Centre (AIAC).  Ms. Samrith was appointed as a panel of three arbitrators for the first time in history of SEA Games during the SEA 2017 games.   She is also a Domain Name Dispute Resolution Panellist with KLRCA and Asian Domain Name Dispute Resolution Centre in Hong Kong.

Ms. Samrith delivers talks to several professional bodies and lectures on Arbitration and is actively involved in the training of arbitrators, adjudicators and mediators.


2) Mrs. Louise Azmi
    - BA Hons English and Related Literature (University of York) in year 2002,
      CPE (City University, London), BVC (Inns of Court School of Law, London)

Mrs Louise Azmi was called to the Bar of England and Wales in July 2004. She was in private practice as a Barrister for 11 years in England until she relocated to Malaysia in 2015. Louise has extensive advisory and litigation experience in several areas of law, appearing at all levels of Court up to the Court of Appeal. She personally conducted five cases to the Court of Appeal, and was led by Queens Counsel in highly complex cases on four other occasions. Louise was noted in the Legal 500 (2013 edition) as having "achieved some frankly astonishing results"

Since relocating to Malaysia Louise has been using her skills in the burgeoning area of Alternative Dispute Resolution. Louise is on the AIAC panel of Adjudicators and Mediators, and the MMC panel of Mediators. She also acts as advisor and advocate in Arbitration, Adjudication and Mediation proceedings. She is a contributor to the CIDB Law Reports 2017, and the Malaysian Law Journal. Louise regularly delivers training and advice on Alternative Dispute Resolution to construction companies in order to ensure that they are complying with the changes in the law, and prepared for any disputes that may arise.
