SYNOPSIS
Following the Government’s call to reform outdated laws, including the Contracts Act 1950, this seminar explores proposed changes to Malaysian contract law, focusing on third party rights and their implications.
Participants will gain a clear understanding of the doctrine of privity of contract, key provisions of the proposed reforms, and their practical impact on the construction industry—all explained in simple, accessible language.
BIODATA OF SPEAKER
Ir. Oon Chee Kheng
Ir. Oon Chee Kheng is the Principal Partner of Messrs CK Oon & Co, a firm with a focus on both contentious and non-contentious construction law, or what he calls the legal aspects of engineering. He holds 3 degrees, BE (Civil), LLB (Hons) and MBA. He has been an Advocate and Solicitor of the High Court in Malaya since 1995.
Ir. Oon is a former Vice President of The Institution of Engineers, Malaysia (IEM), a Fellow of IEM (FIEM), a Professional Engineer (PEng) and has served on various committees under the Construction Industry Development Board Malaysia (CIDB), IEM and other engineering-related organizations. He is a Fellow of both The Chartered Institute of Arbitrators (FCIArb) and Malaysia Institute of Arbitrators (FMIArb) and has had extensive experience acting as mediator, adjudicator, and arbitrator in construction disputes. Within the legal profession, he contributes actively to the Malaysian Bar, having served as Vice Chairman of the Sub-Committee on Arbitration and the Sub-Committee on Construction Law. He is also formerly an External Legal Consultant to the Ministry of Works, Government of Malaysia (Kementerian Kerja Raya).
As a mediator, arbitrator, adjudicator, and counsel, Mr. Oon has participated in numerous construction and arbitration cases, some of which are reported in Malaysian legal journals. He regularly speaks at conferences and seminars, and his articles have been published in the Malayan Law Journal, Commonwealth Law Journal, The Law Review, and others. He is also the co-author of the practitioner text, Adjudication of Construction Payment Disputes in Malaysia (2014).
Ir Oon has been appointed in January 2025 by the Minister of Law and Institutional Reforms as a member of the Committee for the Review and Reform of the Contracts Act 1950 and serves as Chairman of one of its working groups. He is also an invited guest lecturer for the Master of Commercial Law programme at the Faculty of Law, University of Malaya, sharing his expertise and experience with the next generation of legal professionals.
