SYNOPSIS
Almost all experienced engineers are aware of aspects of construction contracts inregard to delays and extensions of time, variations and setting of varied rates, and statutory adjudication.
Therefore this talk aims to inform and educate engineers (and contracts administrators) on issues which are less often encountered or less understood as follows: • Liabilities of construction professionals, i.e. consultants. Sometimes contractors try as a matter of strategy to defend themselves against clients by implying to consultants that they will sue for consequences of any deductions. Can they do this? • Termination of contracts (and sub-contracts) – wrongful termination carries hefty consequences • Liability for defects after practical completion – what is the consequence if the contractor fails to rectify or is slow in rectifying
The proposed talk will address the above and similar questions.
BIODATA OF SPEAKER
Ir. Lim received his Bachelor’s Degree in Civil Engineering from the University ofManchester Institute of Science and Technology and his Bachelor of Law Degree fromthe University of Wolverhampton. He passed his Certificate in Legal Practiceexamination and was called to the Malaysian Bar in 2003. He has been involved inmany major construction projects both as an engineer and a contracts specialist.
Ir Lim jointly updated Halsbury’s Laws of Malaysia “Building & Construction” (a reference encyclopaedia of law for lawyers) title 2006.
