SYNOPSIS
Arbitration is governed by Law, and Rules with more elaborate procedural provisions. In 2003, the IEM Rules was revised to incorporate the UNCITRAL Arbitration Rules (1976) with modifications to suit Malaysian practice and the Law. On 15 March 2006, the Arbitration Act 2005 replaced the earlier Act of 1952. In 2011, some amendments were made to the Act. In 2012, the IEM Rules were amended to incorporate changes to deal with problems experienced with the 2005 Arbitration Act, as well as non-legal practical considerations. In 2016, the Rules were again amended to omit the IEM Scale of Fees for Arbitrators.
This lecture will describe the basic steps in arbitration proceedings and how these are regulated by the Law and the IEM Rules. The lecture is intended to be informative as well as interactive, and before the lecture date participants may wish to familiarise with the Arbitration Act 2005 and IEM Arbitration Rules 2016. EXPERIENCE IN ARBITRATION AND ADR Since 1984 appointed by IEM, KLRCA, the High Court of Malaya and directly by Parties for more than 50 cases of arbitration, mediation and contractual adjudication. Acted as Expert Advisor to Parties for settlement of claims. Principally responsible for drafting and updating the IEM Arbitration Rules (2003, 2012 & 2016).
