SYNOPSIS
The law which governs construction contracts is a combination of different branches of law. Principally, of course is contract law. However, consultants are also governed by the law of torts, which was the basis on which the families of the victims of the Highland Towers tragedy would have been able to sue the engineer who designed the Towers and developers of the neighbouring lots. In the latter case there is no contractual relationship between the families of the victims and the engineer and the neighbouring developers.
Agency law, which is a specialized area of the law of contract is also involved as developers and contractors act via their employees.
This talk will explain the relevant areas of the law and seek to draw a common thread through them.
The talk is essentially aimed towards all those who have to administer construc-tion contracts.

Ir. Lim received his Bachelor’s Degree in Civil Engineering from the University Of Manchester Institute Of Science and Technology and his Bachelor of Law Degree from the University of Wolverhampton. He passed his Certificate in Legal Practice examination and was called to the Malaysian Bar in 2003.
As an engineer his main area of experience was in the design of water supply pro-jects and the construction of large-scale infrastructure works including roads and a rock fill dam. His main interest in civil engineering works was in the setting out of the works.
As a lawyer he is involved in contract administration (including applications for ex-tensions of time and their evaluation) as well as acting as a specialist in advising lawyers involved in construction contracts disputes.
Ir. Lim also updated Halsbury’s Laws of Malaysia in 2006 and 2012 (the latter not published due to technical reasons) and is a frequent presenter of talks on construction contracts.
