SYNOPSIS
The Registration of Engineers Act 1967 (REA) is an Act of Parliament enacted to provide for the registration of engineers, and sole proprietorships, partnerships and bodies corporate providing professional engineering services. Under the REA, only registered Persons and registered Engineering Consultancy Practices (ECPs) are entitled to provide professional engineering services or to assist the Professional Engineer in the supervision of engineering works. The Registration of Engineers Regulations 1990 (RER) is a subsidiary legislation prescribed by the Board of Engineers Malaysia (the Board) to enable it to perform its functions or to exercise any of its powers set out under the REA. The RER prescribes the Code of Conduct expected of a registered Person.
This MOGEC talk will look at the provisions of the REA and the RER, including the different categories of registration, the entitlements for each category of registration, the enabling requirements for registration as a registered person or a registered ECP, and the penalties for any infringement of the REA. A registered person or registered ECP who contravenes the REA can be subjected to disciplinary action while a non-registered person or business can be subjected, on conviction, to a fine or to imprisonment.
