SYNOPSIS
The Malaysia Competition Commission (MyCC) is an independent body & agency, mandated to enforce the Competition Act 2010 (Act 712). An Act that encourages economic development by promoting and protecting the process of competition; beneficial to consumers, businesess and the economy. Section 4 of the Act prohibits anti-competitive agreements, also known as cartel, conducts between enterprises; that could significantly prevent, restrict or distort competition in any market. This leads to the lack of innovation by enterprises and consequently putting consumers at a disadvantage.
Price Fixing is one of the infamous cartel conducts by business operators and associations; and is described as a practice of colluding with others to fix a price on a product, rather than allowing the official price to be determined by the market. But what about fixed fees set by associations? Does it infringe the Act itself?

BIODATA OF SPEAKER
1 ) Puan Zainab Hanis bt Zulkifli
SESSION 1 – Understanding Principle of Competition: Differentiating Between Cartels and Associations
Ms. Zainab Hanis bt Zulkifli is an Assistant Director, attached under the Investigation and Enforcement Division (IED) of the Malaysia Competition Commission (MyCC). She holds a Master of Laws in Competition Law Degree from King’s College London, United Kingdom. Prior to her employment at the MyCC, Ms. Hanis was a Pupil-in-Chambers at Shearn Delamore & Co.; and was called to the Bar Council as an Advocate and Solicitor of the High Court of Malaya in August 2017. In 2019, Ms. Hanis was one of the representatives from the ASEAN Member State countries; who got selected to participate in a 3 months Secondment Program at the Australian Competition and Consumer Commission (ACCC) in Sydney, Australia.
2) Encik Ismail Faruqi bin Abdullah
SESSION 2 – The Liberalisation of Fixed Fees: Is This an Attainable Reality?
Encik Ismail Faruqi bin Abdullah is a Senior Assistant Director for Strategic Planning & International Affairs Division for Malaysia Competition Commission (MyCC) where he wears multiple hats, including leading the Business and Economics Department to conduct market studies, evaluating the exemption application, assessing Competition Cases as well as providing economic research and advice to Government. He is also taking a leadership role as a pioneer for Mergers and Acquisition Team as well as overseeing and managing strategic planning for the Malaysia Competition Commission.
Encik Ismail Faruqi starts his career as an Economic Researcher at the Economic Planning Unit, Prime Minister Department and the National University of Malaysia. Prior to joining the Malaysia Competition Commission, he was appointed as an Economist at CIMB Bank Malaysia. Ismail Faruqi has completed his Competition Summer Course from Colleague of Europe, Bruges Belgium. On the same note, Encik Ismail Faruqi also graduated from National University of Malaysia in a Master’s Degree in Econometrics and Degree in International Economics and Trade.
