SYNOPSIS
The KLRCA was established in 1978 to provide institutional support as a neutral and independent venue for the conduct of domestic and international arbitration proceedings in the region. It has since developed into a regional premier institution for the administration of ADR (alternate dispute resolution) proceedings which include mediation, adjudication and arbitration. Disputes in the construction industry arise with a high frequency. One common problem often encountered in construction contracts is disputes over late or non-payment for work done or goods supplied. The Construction Industry Payment & Adjudication Act 2012 (“CIPAA”) seeks to address and mitigate these problems. The late Lord Denning, English jurist, has famously said: “Cash flow is the life-blood of the construction industry”. Since CIPAA came into force on 15 April 2014, there has been a fast growing list of construction industry disputes referred for adjudication to the KLRCA, the institution empowered under CIPAA to administer adjudications and to train and maintain a register of adjudicators
Objective
Participants of this visit will gain a good knowledge of the role and functions of the KLRCA, the various ADR procedures available that are administered by KLRCA, and how building professionals (engineers included) can qualify to be emplaced on the panel of adjudicators of the KLRCA. All participants will be presented with a set of the KLRCA administered Acts, Rules and Regulations and other relevant documentation.
