SYNOPSIS
In meeting various challenges faced by the Government and to achieve value for money, the Government has adopted various procurement approaches/methods namely Build contract, Design and Build contract, Public Private Partnership (PPP) which can broadly divided into Build Operate Transfer and Private Finance Initiative and Alliancing Contract ( which the Government is currently exploring ).
The key differences with respect to the above are mainly responsibilities – technical and financial, risks allocation, performance expectation/measurement, role of the parties and consequences of termination.
For the Build and Design & Build procurement, the standard form of contract were well established. However, for PPP (with respect to the construction), a standard form of contract/guideline is yet to be developed. Often there are confusion in terms of the role and responsibilities of the Government Representative for the PPP projects during construction and maintenance.
Based on the above scenario, the KSU of Ministry of Works would like to have a Kopitiam session with IEM to explore and exchange ideas on the subject with the objective to establish a standard guideline in the near future, in supervising/monitoring PPP projects to ensure: 1. Understanding/appreciation of some of the salient terms/differences for each of the above procurement methods; 2. Quality and best practices are not being compromised, while ensuring the element of creativity and innovation for the project; 3. Value for money being achieved by the Government over the life cycle of the project; 4. Optimum risks allocation to the parties that can best manage the risks; 5. Timely project completion.
BIODATA OF SPEAKER
Dato’ Sri Zohari Bin Hj Akob is currently the Secretary General, Ministry of works since July 2014 He started his career in 1986 in LKIM. After he completed his Master in Economics in 1995, he held various post in the Economic Planning Unit until Mac 2009 where he was the Director, Privatisation. In April 2009, he was appointed as the Deputy Director General (Development), UKAS. In July 2012, he was promoted to Deputy Director General (Policy), UKAS. Subsequently, in January 2014, he was appointed as the Deputy Secretary General, KETTHA.
