Synopsis
For the past 20 years there has been a remarkable surge in the implementation of engineering and building contracts on design and build method of procurement. Among the contributory factors are the obvious advantages of single-point responsibility, likely guaranteed cost of construction, more certain completion time and reduced opportunities for claims by the contractors. Of course the above advantages can only be achieved if important and key principles are observed by the parties involved ie the Employer, the Contractor, the Professionals (Architects, Engineers, QS etc) and the Project Managers.
This short course is designed to achieve 2 objectives. Firstly to provide a practical guide to assist the parties in knowing what to do when performing a Turnkey/Design and Build Contract; secondly, to assist parties in knowing some potential problems and pitfalls of Turnkey/Design and Build Contract and the possible ways to minimize them in the course of the work.
About The Course Leader
Ir. Lai S C graduated as a Mechanical Engineer from the University of Malaya. He also holds LL.B degree from the University of London and LL.M from the University of Malaya, majoring in Alternative Dispute Resolution, Arbitration Law, Remedy and Construction Law. In addition, he also holds a Certificate of Legal Practice from the Qualifying Board of Malaysia and Diploma in International Commercial Arbitration (UK).
Ir. Lai has more than 30 years working experience in the field of construction and property development. He is currently the Managing Director of a consulting firm involved in Construction Claims and provision of Contract/Project Management services. Ir. Lai had been invited to deliver papers on water supply and sewage treatment in various international seminars and conferences. He has also written various articles on ADR, Arbitration and Construction Law and had conducted talks on Law for Engineers and Construction Law to local companies and Universities.
Being an accreditor of Engineering Accreditation Council Malaysia, he is also actively involved in the accreditation of local engineering programmes. Ir. Lai is also appointed as the Student Ambassador for the External Law Programme of University of London. He is currently empanelled as Arbitrator, Mediator and Adjudicator in the panel of Asia International Arbitration Centre (AIAC).
