SYNOPSIS
Delay and Disruption Protocol was published by the Society of Construction Law, United Kingdom,in October 2002. The Protocol is able to solve many delay and disruption issues that arise in construction contracts, especially for recovering an extension of time and/or compensation. On the other hand, construction sector is one of the important sectors that contribute to economic growth. However, the construction sector has not escaped from the delay problems in Malaysia. Under the local standard form of contract, it is found out that none of them provides a detailed guidance for the delay and disruption issues. The forms only state the general procedures and entitlement for EOT, for example, under the Clause 23.0 and 24.0 in Pertubuhan Arkitek Malaysia (PAM) Contract 2006, Clause 24.0 and 31.0 in Construction Industry Development Board (CIDB), Clause 43.0 and 44.0 Public Works Department (PWD) 203A form (Rev.2010), Clause 43 and 44 in Institution of Engineers, Malaysia Form of Contract for Civil Engineering Works (IEM.CE) 2011. It would cause the parties certain contractual disagreements, especially in applying different approaches in dealing with the delay and disruption issues. It is necessary for having a clear guidance for administrating these delay and disruption issues.

Dr. Chong Heap-Yih graduated PhD in Civil Engineering (Construction Engineering & Management), Faculty of Civil Engineering (FKA), Universiti Teknologi Malaysia (UTM), Skudai, Johor. Currently, he undertaking LLB degree, Bachelor of Laws, from Univeristy of London, United Kingdom (Part time) He is an Assistant Professor / External Consultant at Universiti Tunku Abdul Rahman (UTAR). He has worked as external consultant on a project basic at a number of companies such as, Chew Kiong Lam Construction Pte. Ltd. and Co Sun Construction Building Pte. Ltd. as well as involved in internships at Labrous Holding Pte. Ltd. and Kennex Reality Pte. Ltd.
